Vezetői összefoglaló:

A Tanács politikai megegyezéseként szereplő direktívatervezetnek nem sikerül a számítógéppel implementált találmányok szabadalmaztathatóságára vonatkozóan egyértelmű szabályokat felállítania. A szabadalmaztathatóság mindhárom feltétele a definíciók hiányosságai miatt lényegesen eltérő értelmezésekre ad lehetőséget. A direktívatervezet egyértelműen lehetővé teszi az üzleti módszerek szabadalmazását. A direktívatervezet szövege kodifikációs szempontból alacsony minőségű, önellentmondásokat tartalmaz, és ellentétben áll a TRIPS egyezménnyel.

Recital 14 """ The legal protection of computer-implemented inventions does not necessitate the creation of a separate body of law in place of the rules of national patent law. The rules of national patent law remain the essential basis for the legal protection of computer-implemented inventions. The Directive simply clarifies the present legal position with a view to securing legal certainty, transparency, and clarity of the law and avoiding any drift towards the patentability of unpatentable methods such as obvious or non-technical procedures and business methods. """

Amennyiben a nemzeti szabadalmi törvények maradnak a jogi védelem eszközei, akkor nincs szükség a direktívára, tehát a direktíva léte ellentmond ennek a recitalnak. A harmadik mondat szerint a direktíva pontos szabályokat fektetne le. Mint a főszövegből látni fogjuk -a Parlament által elfogadott változattal szemben- ezt nem teszi. A direktíva az EPO jelenlegi működését próbálja legitimálni. Az EPO-nál jelenleg több tízezer triviális, nem technikai, és üzleti módszerekre vonatkozó szabadalom van bejegyezve.

Összefoglaló: A direktíva léte ellentmond a recital első mondatának. Ez a recital hibásan állítja azt, hogy a főszöveg pontos szabályokat fektetne le.

Eszerint az interoperabilitást biztosítani kívánó félnek kell bonyolult procedúrán keresztül biztosítania a lehetőséget. Az ehhez szükséges erőforrások sok esetben nem állnak rendelkezésre.

A domináns szolgáltató a szabályt nagyon egyszerűen megkerülheti úgy, hogy a szabadalmat eladja és visszalicenszeli.

Összefoglaló: Ez a recital a gyakorlatban nem gátolja az interoperabilitás szabadalmakkal történő megakadályozását.

A szerzői jogi direktíva ide vonatkozó szabályai szabadalmak esetén nem értelmezhetőek: A visszafejtésre vonatkozó pontok értelmezhetetlenek, hiszen a szabadalmi bejegyzésnek tartalmaznia kell azokat az információkat, amelyek alapján az ötlet implementálható. A szabadalmi bejegyzés nem adott programhoz köthető, ezért a direktívának az a kitétele hogy tulajdonolni kell azt a programot amellyel interoperabilitást kívánunk elérni, értelmezhetetlenné teszi az interoperabilitásra vonatkozó kitételt is a szabadalmakra vonatkozóan.

Összefoglaló:

Ez a recital a szabadalmi jogi környezetben nem értelmezhető.


Article 2

""" (a) "computer-implemented invention" means any invention the performance of which involves the use of a computer, computer network or other programmable apparatus, the invention having one or more features which are realised wholly or partly by means of a computer program or computer programs.

(b) "technical contribution" means contribution to the state of the art in a field of technology which is new and not obvious to a person skilled in the art. The technical contribution shall be assessed by consideration of the difference between the state of the art and the scope of the patent claim considered as a whole, which must comprise technical features, irrespective of whether or not these are accompanied by non-technical features. """

1. Az (a) bekezdésből az EP szöveghez képest hiányzik: -az, hogy az Európai Szabadalmi Szerződés által adott szabadalmazhatósági

3. Az a kitétel, hogy az igénypontok összességét kell tekinteni, és hogy azok között lehetnek nem-technikai tulajdonságokat leírók, szabad utat nyit az üzleti módszerek szabadalmaztatása előtt azáltal hogy azok számítógépes implementációját írja le a szabadalmi igény.

A definíciók közül kimaradt az EP által adott "field of technology" (2c, lásd fennt) és "industry" definíciója.

Összefoglaló:

A direktíva céljául szolgáló pontos szabályok lefektetését az ebben a cikkelyben található definíciók adnák meg. Az EP változathoz képest több alapvető definíció törlésre került. A megmaradt definíciók többféleképpen értelmezhetőek, és szabad utat nyitnak az üzleti módszerek szabadalmazása előtt.

Az "industrial application" kitétel az "industry" definíciójának hiánya miatt nem egyértelmű. A "technical contribution" nem megfelelő definíciója miatt (lásd Art. 2b), a kifejezés gyökeresen eltérő értelmezéseire nyílik lehetőség. A gyakorlat megmutatta, hogy az EPO nem képes az újdonság kritériumát megfelelő módon vizsgálni. Az EP szövegváltozata ezért tartalmazza a 4.3 szakaszt, amely az újdonság eldöntésében segít: """ 3. The significant extent of the technical contribution shall be assessed by consideration of the differences between all of the technical features included in the scope of the patent claim considered as a whole and the state of the art, irrespective whether or not such features are accompanied by non-technical features. """

Ennek a szakasznak a hiányában a "new" kitétel értelmezése is nehézkessé válik.

Összefoglaló: A szöveg a 2. cikkely definíciós problémái és az egyértelmű megfogalmazások hiánya miatt a szabadalmaztathatóság MINDHÁROM feltételét fellazítja.


Article 4a

""" 1.(new) A computer program as such cannot constitue a patentable invention.

2. A computer-implemented invention shall not be regarded as making a technical contribution merely because it involves the use of computer, network, or other programmable apparatus. Accordingly, inventions involving computer programs whether expressed as source code, as object code or in any other form, which implement business, mathematical or other methods and do not produce any technical effects beyond the normal physical interactions between a program and the computer, network or other programmable apparatus in which it runs shall not be patentable. """

A 4a.1. szakasz direkt ellentétben áll az 5.2 szakasszal.

A 4a.2 szakaszt érdemes az EP által elfogadott 5. cikkellyel összevetni: """ A computer-implemented invention shall not be regarded as making a technical contribution merely because it involves the use of computer, network, or other programmable apparatus. A "whether expressed as source code, as object code or in any other form" kitétel beszúrása arra alkalmas, hogy ennek segítségével a teljes programot vagy programrészletet ("as such"), amelyre a fenti leírási módok relevánsak, meg lehessen különböztetni a programötletektől, amelyeknél nem relevánsak a fenti leírási módok. Ezáltal lehet úgy érvelni, hogy a programötletekre az 5.2 szakasz megszorításai nem vonatkoznak.

A "technical effects beyond the normal physical interactions" kitétel értelmezésében az EPO T1173/97-es döntését lehet figyelembe venni, amely a "further technical effect" bevezetésével széles körben alkalmazható kiskaput talált a kitétel alól, azáltal hogy az informatikai rendszeren belüli erőforráskihasználás javítását technikai effektusként tünteti fel. Ennek a kiskapunak a bezárását szolgálja az EP által elfogadott változat 6. cikkelye: """ Member States shall ensure that computer-implemented solutions to technical problems are not considered to be patentable inventions merely because they improve the efficiency in the use of resources within the data processing system. """

Ez a cikkely szintén kimaradt a politikai megegyezés szövegéből.

Öszefoglaló: A szakasz a szabadalmaztathatóság korlátai közé a "további technikai effektus" definiálatlansága, és az programok "mint olyanok" és a programozási ötletek szétválasztása miatt könnyen kihasználható kiskapukat iktat be.


Article 5

Member States shall ensure that a computer-implemented invention may be claimed as a product, that is as a programmed computer, a programmed computer network or other programmed apparatus, or as a process carried out by such a computer, computer network or apparatus through the execution of software.

A claim to a computer program, either on its own or on a carrier shall not be allowed unless that program would, when loaded and executed in a computer, programmed computer network or other programmable apparatus, put into force a product or process claimed in the same patent application in accordance with paragraph 1.

Az 1. szakasz "or as a process carried out by such a computer" kitétele az üzleti módszerek szabadalmaztathatóságát engedélyezi, különösen ha figyelembe vesszük azt hogy a szakasz a szabadalmaztathatóságnak a direktíva egyéb részeiben megfogalmazott keretein túli lehetőségeket definiál a "may" kitétel alkalmazásával.

A 2. szakasz "unless" utáni része bármely informatikai termék esetén könnyen teljesíthető, így a szakasz értelme: "A claim to a computer program, either on its own or on a carrier should be allowed." Ez direkt ellentétben áll a 4a.1 szakasszal, és a TRIPS egyezménnyel.

Összefoglaló: A cikkely direkt módon lehetővé teszi az üzleti módszerek szabadalmaztathatóságát, ellentétben áll a direktíva más szakaszaival és a TRIPS egyezménnyel.
